These Terms and Conditions are the regulations referred to in Article 8 of the Act of July 18, 2002, on the provision of electronic services (Journal of Laws of 2002, No. 144, item 1204, as amended), and also govern the conditions of concluding Sales Agreements on the Website, in accordance with the provisions of other acts appropriately regulating this obligation. The Website is operated by Zofia Szuca, conducting business under the name: DigitSoph Studio by Zofia Szuca.

The Website operates based on applicable legal regulations and with respect for good business practices, particularly considering e-commerce standards regarding the quality of goods and the service of conducted transactions.

Definitions:

  • Terms and Conditions: This document along with its attachments, informing about the obligations and rights of the Contracting Parties.
  • Party: The Client or the Seller; the term “Parties” refers to both the Client and the Seller collectively.
  • Distance Agreement: An agreement concluded with the Client within an organized system for concluding agreements at a distance, without the simultaneous physical presence of the Parties, using one or more means of distance communication until the conclusion of the agreement.
  • Website: The online store available at zofiaszuca-art.com.
  • Seller: The online store available at zofiaszuca-art.com.
  • Client: A natural person, legal person, or an organizational unit without legal personality, granted legal capacity by law, purchasing products or services through the Website.
  • Consumer: A natural person purchasing products or services through the Website for purposes not directly related to their business or professional activity.
  • User: Any entity using the Website.
  • Account: The User panel available immediately after the payment is recorded, accessible after logging in with a password sent to the provided email address.
  • Payment Method: The form of payment for the ordered product or service chosen by the Client during the ordering process, offered by the Website or individually arranged in a different form than those presented on the Website.

§1 General Provisions The Website’s activity is the sale of digital products. Matters not regulated by these Terms and Conditions are governed by applicable laws in the Republic of Poland, especially the Civil Code (Journal of Laws No. 16, item 93, as amended), the Consumer Rights Act of May 30, 2014 (Journal of Laws 2014, item 827), and the Personal Data Protection Act of August 29, 1997 (consolidated text: Journal of Laws of 2002, No. 101, item 926, as amended).

The content on the Website and the digital products offered by the Service Provider do not constitute a commercial offer within the meaning of the Civil Code. The price list on the Website does not constitute a commercial offer within the meaning of the Civil Code.

§2 Order Placement Procedure and Moment of Agreement Conclusion The Client may place orders on the Website 24/7 through zofiaszuca-art.com. The Website conducts sales in Poland and abroad. Product and service information presented on the Website is commercial information within the meaning of the Civil Code.

Placing an order constitutes an offer under the Civil Code made to the Seller by the Client. To place an order, the Client should use the e-store at zofiaszuca-art.com. Once the order is correctly placed, it is confirmed via email. The agreement is considered concluded when the Client receives an email confirming the order. Upon payment confirmation, a direct download link for the purchased eBooks and online courses will be immediately sent to the Client’s email.

§3 Payments All prices on the Website are gross prices in USD, including VAT. Payment methods include: a) Online payment via Dotpay b) Bank transfer c) PayPal The Client places orders according to prices valid at the time of ordering. The Website reserves the right to change prices, which does not apply to orders already placed.

§4 Complaint Procedure Complaints related to services via the Website and inquiries should be sent to: zofia.szuca@gmail.com. A correctly submitted complaint should include the Client’s details (name, surname, address, email, contact number) and a description of the issue.

If additional information is needed, the Service Provider will request it, which may extend the complaint resolution time. For consumer agreements, the Website is liable according to Articles 556 and subsequent of the Civil Code. The Website will respond within 14 days. Lack of response implies the Seller accepted the claim.

§5 Withdrawal from Agreement, Termination of Use The Consumer may withdraw from a distance agreement within 14 days without giving any reason, by submitting a written statement. It can be sent electronically or by mail. A withdrawal form is attached to these Terms and Conditions. The User can discontinue using the Website at any time. The Seller reserves the right to suspend or terminate the Website’s operation at any time.

§6 Technical Requirements and Cookies Recommended technical requirements: a computer with internet access, email access, and a web browser. The Website uses cookies to recognize the User’s device and adjust the display accordingly.

Types of cookies:

  • Persistent cookies: stored for a specified time or until manually deleted.
  • Session cookies: deleted when logging out, leaving the website, or closing the browser.
  • First-party cookies: placed by the Website owner.
  • Third-party cookies: placed by external entities, e.g., Google Analytics.

§7 Final Provisions The Service Provider reserves the right to make changes to the Website’s content and pricing due to market changes. The Service Provider is not liable for: a) Damages caused by Users violating third-party rights. b) Disruptions or unavailability beyond the Service Provider’s control. c) Other damages from non-compliance with these Terms.

Changes to these Terms and Conditions will be announced at least 14 days in advance. Orders placed before changes will be processed under the previous Terms. Disputes with Consumers will be settled by a competent common court. Disputes with non-consumers will be settled by a court competent for the Website’s location.

Consumers can seek out-of-court dispute resolution through: a) Permanent consumer arbitration courts b) Mediation c) Provincial Trade Inspectorates d) Free consumer helpline: 800 007 707.

These Terms and Conditions are effective from February 1, 2025.
